These Official Rules govern all contests, sweepstakes, and promotional giveaways conducted by Nevada Heating (“Sponsor,” also known as “Nevada Heating”) and its affiliates. By entering, you agree to these Official Rules and the decisions of Nevada Heating, which are final and binding. Note: Nevada Heating reserves the right to change, suspend, or terminate any promotion or prize at any time without prior notice. All promotions are subject to applicable federal, state, and local laws.
SMART MEMBER SURVEY SWEEPSTAKES PROMOTION OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS DEPEND ON NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED.
READ BEFORE ENTERING. These Official Rules contain important information about how the Promotion will be conducted, and about your rights, including a class action waiver, jury waiver, and arbitration agreement. Submitting a survey constitutes agreement to these Official Rules.
This Smart Member Survey Sweepstakes Promotion (“Promotion”) is sponsored by Goettl Home Services, LLC ("Sponsor"), with the prize fulfilled by either Sponsor or its subsidiaries, Las Vegas Peach, LLC, Peach Home Services, LLC, Austin Air Rescue LLC, Phoenix Peach LLC, Las Vegas Peach, LLC d/b/a Nevada Heating (together "Subsidiaries" and individually, each a "Subsidiary").
Eligibility:
Open only to individuals who are at least 18 years of age with a home located within Sponsor’s and its Subsidiaries’ service areas. Submissions outside of the respective, qualifying geographic regions will not be considered. For inquiries as to whether your home qualifies, consult Nevada Heating’s website at https://www.nevadaheating.com. Must be a current Nevada Heating Smart member to complete survey and qualify for automatic entry upon submission. Employees of Sponsor, its parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. This Promotion is subject to all applicable federal, state and local laws. Void where prohibited.
Entry Period:
Promotion entry period begins on January 23, 2026, at 12:00 a.m. Pacific Time (“PT”) and ends February 22, 2026, at 11:59 p.m. PT (“Entry Period”). Sponsor’s computer is the official time keeping device for the Promotion.
How to Enter:
You will receive one (1) automatic entry upon proper submission and receipt of your completed Nevada Heating Smart member survey. Limit one (1) survey and one (1) entry per person and per email address, regardless of number of memberships associated with the individual or email address.
Alternatively, persons who do not currently subscribe to a Smart Membership Plan or who do not wish to submit a survey may enter by sending an email to: [email protected] with the subject line: Nevada Heating Smart Member Survey Sweepstakes Promotion AMOE Submission. In the text of the email, you must provide your full name, email address, phone number, home address, whether you have a current membership plan with Sponsor, and affirm the following: “By emailing this AMOE Submission, I submit that I have read and agree to the Promotion Official Rules.” Entrant does not qualify, and any AMOE Submission will be deemed ineligible, if the home address is not located within any of Sponsor’s and its Subsidiaries’ service areas.
Limit one (1) entry per person, email address, phone number, home address, and household, regardless of method of entry. Sponsor is not responsible for unreceived entries. Proof of sending, regardless of method of entry, is not proof of receipt. Entries will not be acknowledged or returned.
Any and all entries that are early, late, lost, illegible, unintelligible, garbled, incomplete, damaged, destroyed, irretrievable, forged, manipulated, tampered with, modified, edited, adjusted, inappropriate, lewd, offensive, noncompliant, or otherwise inconsistent with the requirements of these Official Rules may be disqualified at Sponsor’s sole and absolute discretion. Entries generated by script, macro, or other automated or artificial means and entries by any means which subvert the entry process are void. Attempts by an entrant to circumvent these Official Rules will subject all entries submitted to disqualification.
By submitting an entry, regardless of method of entry, entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Promotion, including, without limitation, interpretation of the Official Rules.
In the event of a dispute as to the identity of any entrant who submits an entry, the entry will be deemed submitted by the holder of the email account associated with the submission but only if such person is otherwise eligible. The “account holder” is the person assigned an email address or service by the organization responsible for assigning addresses for the domain associated with the submitted address. Winner may be required to show proof of being the registered account holder. If a dispute cannot be resolved to the Sponsor’s satisfaction, the entry will be deemed ineligible.
Prize:
One (1) winner will win a comped renewal of their existing Smart Membership Plan (or of the next highest plan if their plan is no longer offered*). Approximate retail value (ARV) of Prize thus varies and depends on the existing membership level at time of entry; however, ARV will not exceed $1,500. Only one (1) person can win.
Prize has no cash value. Any price differential between the stated ARV maximum and the actual prize awarded is not payable to the winner. No substitution, transfer, or cash equivalent is permitted except by Sponsor in its sole discretion. Winner is solely responsible for each and all respective taxes, expenses, and other costs associated with receipt of Prize. No more than the stated Prize will be awarded.
*For current subscribers to a membership plan that is no longer offered by Sponsor, the prize awarded will be a comped renewal at the next available level. Sponsor currently offers two different Smart membership plans, each with a one-year or two-year option. In the past, Sponsor may have offered other membership plans at other duration increments. Any such plans which are no longer offered are non-renewable. Accordingly, if the selected winner’s existing membership plan is one that is no longer offered, the next highest value plan will be awarded as the prize and such a “comped renewal” (albeit for a lesser duration) will be automatically reflected in the winner’s account and honored at the time of the existing plan’s expiration. For clarity, and by way of example, if the winner currently holds membership plans covering 3 homes, each with a 5-year duration including the Nevada Heating App Only, then the winner will be renewed for 3 membership plans at a 2-year duration, for the Nevada Heating App Only, covering the 3 homes.
If the selected winner is from among the AMOE submissions of a non-member, the prize awarded will be for the Smart 1-year Nevada Heating App Only Membership Plan.
Odds:
Odds depend on number of eligible entries received.
How to Win:
One winner will be selected by random draw, within thirty (30) days of the close of the Entry Period, from among all eligible entries received. Prize will be automatically applied to winning membership account by Sponsor and/or the applicable Subsidiary such that the awarded membership plan will be effectively auto-renewed and at no cost to the winner. Sponsor will endeavor to contact the winner by phone and/or email to notify of the prize awarded. If the selected winner is from among the AMOE submissions of a non-member, however, the prize cannot be awarded without affirmative contact with Sponsor. In the case of such an AMOE non-member draw, Sponsor will endeavor to contact the winner by phone and email. If Sponsor is unable to reach such winner or is unable to effectively communicate with such winner in order to establish an account and membership plan within five (5) days of initial outreach by Sponsor, or if such winner declines the Prize, this initial winner will be deemed to have forfeited the Prize and Sponsor may select a new winner by random draw in its sole discretion. Sponsor shall have no further obligation to attempt to draw another winner and issue the Prize, but may do so in its sole discretion, if it so chooses.
Sponsor is not responsible for and shall not be liable for late, lost, garbled, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winner. Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent value prize substitutions in its sole discretion.
To be eligible to win, entrant must reside within the applicable Sponsor and Subsidiary service areas. The qualifying home(s) associated with the eligible entrant will be the residence where the Prize is to be applied. Location will be verified in order to win. Sponsor may disqualify any potential winner in its sole discretion if potential winner does not satisfy all criteria for verification.
Miscellaneous:
Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of Prize, whether or not specifically stated herein, are the responsibility solely of the Winner. Winner may be required to provide Sponsor with a valid social security number or tax identification number for tax reporting purposes before their prize will be awarded. An IRS Form 1099 may be issued in the name of the winner for the value of the Prize. Unclaimed prize(s) will be forfeited.
Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent value prize substitutions at its sole discretion.
General Conditions:
By submitting an entry, entrant consents to receive communications from Sponsor related to this Promotion and agrees to be bound by these Official Rules. Entrant also agrees to receive promotional email from Sponsor and its Subsidiaries and may opt out from such communications at any time. Note that if entrant opts out from communications from Sponsor during the course of this Promotion, entrant may be forfeiting the chance to win if Sponsor or its Subsidiaries are not authorized to contact entrant.
Sponsor reserves the right to cancel, suspend, and/or modify the Promotion, or any part of it, if any fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, garbled, or illegible entries, whether electronic or mail; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or electronic submission of entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, any website associated with the Promotion, and/or the legitimate operation of the Promotion; to violate or otherwise fail to comply with the Official Rules; or to act in an unsportsmanlike, inappropriate, lewd, lascivious, or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Promotion is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect entries, modify the Promotion or suspend the Promotion to address the impairment, and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules, or Sponsor may alternatively determine to end the Promotion early and award the Prize in accordance with these Official Rules from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor’s administration of this Promotion is final and binding.
The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision or of the Official Rules generally. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials, privacy policy, or terms of use on a Promotion-related website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control.
By participating, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to the Promotion, including interpretation of these Official Rules and the winner determination process. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of any of these Official Rules, or in a disruptive manner, and void any associated entries.
Limitation of Liability:
By entering, entrants agree to release and hold harmless Sponsor and its Subsidiaries, and each of their respective affiliates, advertising and promotion agencies, partners, representatives, agents, attorneys, successors, assigns, employees, officers and directors (the “Released Parties”), from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Promotion and/or the entrant’s acceptance, possession, use, or misuse of Prize or any portion thereof; (ii) unauthorized human intervention in any part of the Promotion; (iii) electronic or human error in the administration of the Promotion or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail or electronic mail or transmission; (viii) impossibility, Act of God, or frustration of purpose; or (ix) based on publicity rights, defamation or invasion of privacy.
Disputes, Venue, and Governing Law:
This Promotion is governed by and shall be construed in accordance with the laws of the State of Nevada, without resort to conflict of laws principles. By participating in this Promotion, entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION. Entrant further agrees that any such disputes and causes SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION in Clark County, Nevada, in accordance with the American Arbitration Association (AAA). Any demand for arbitration must be filed within one (1) year from the end of the Entry Period or the cause of action shall be forever barred.
There is no judge or jury in arbitration, and ENTRANT EXPRESSLY WAIVES RIGHT TO A JURY TRIAL. The arbitration will be conducted before a neutral single arbitrator, whose decision will be final and binding, and the arbitral proceedings shall be governed by the AAA Commercial Arbitration Rules, Consumer Due Process Protocol, and Supplementary Procedures for Resolution of Consumer Related Disputes.
In the event that a court of competent jurisdiction finds the foregoing arbitration provisions invalid or inapplicable, entrant acknowledges and agrees that jurisdiction shall be exclusively in the federal and state courts located in Clark County, Nevada, and entrant further agrees to submit to the exercise of personal jurisdiction of such courts for the purposes of litigating any applicable dispute or claim.
BY ENTERING THIS PROMOTION, ENTRANT AGREES TO WAIVE ANY RIGHT TO A TRIAL BY JURY AND FURTHER AGREES AND ACKNOWLEDGES THAT ANY CAUSE SHALL BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.
Further, the remedy for any such dispute or claim shall be limited to actual damages, and under no circumstances shall entrant be permitted to obtain awards for, and entrant hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e., costs associated with participating in the Promotion) not to exceed one hundred dollars ($100.00). Entrant irrevocably waives all rights to have damages multiplied or increased, or to rescind this agreement or to seek injunctive or any other equitable relief. Entrant agrees that remedies are limited to a claim for money damages (if any).
Publicity:
Except where prohibited, participation in the Promotion constitutes winner’s consent to Sponsor’s and its Subsidiaries’ and their respective agents’ use of winner’s name, likeness, photograph, opinions, and/or location(s) for promotional purposes in any media, worldwide, without further permission, payment, or consideration.
Privacy Policy:
By participating in this Promotion, each entrant expressly consents to the Sponsor and its Subsidiaries, and all of their respective agents, employees, and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Promotion and in accordance with Sponsor’s privacy policy. All personal information collected is subject to the Nevada Heating Privacy Policy, available at https://www.nevadaheating.com/privacy-policy.
